1. Preamble These General Terms and Conditions of Sale (GTCS) govern the sales made on the HouseSmoke website (https://www.housesmoke.com). By using this site, you unreservedly accept these GTCS. Please read them carefully before placing an order.

3. Products HouseSmoke offers a range of smoke-related products, including but not limited to smoking accessories, and decorative items. The products offered for sale are those displayed on the site at the time of user consultation, within the limits of available stock.
3.1 Descriptions and Photographs The descriptions and photographs of the products on the site are as accurate as possible. However, colors and sizes may vary slightly depending on screens and display settings.
4. Prices All prices displayed on the site are in Swiss Francs (CHF) and include all applicable taxes (VAT). Delivery charges are calculated separately and displayed before order validation. HouseSmoke reserves the right to change prices at any time, but products will be invoiced based on the rates in effect at the time of order validation.
5. Orders
5.1 Order Process
To place an order, the user must follow the following process:
- Select the products and add them to the cart.
- Verify the contents of the cart.
- Validate the order after verification.
- Provide delivery and payment information.
- Confirm the order. Once the order is placed, HouseSmoke will send an order confirmation via email.
5.2 Order Acceptance
HouseSmoke reserves the right to refuse any order for legitimate reasons, including non-payment of previous orders or anomalies in the order.
6. Payment
Payment can be made via TWINT, credit card, debit card, or any other accepted payment method on the site. Transactions are secure through SSL connection.
7. Delivery
7.1 Delivery Terms
Products are delivered to the address provided by the user during the order. HouseSmoke offers standard mail delivery.
7.2 Delivery Times
Orders placed before 3:00 PM from Monday to Friday are shipped the same day via A-mail. If the postal service meets its deadlines, you should receive your order in your mailbox by the next business day.
8. Receipt of Products & Examination and Complaint Obligation, Liability for Defects
8.1 The customer is obliged to check the condition of the products upon receipt. In case of damaged or missing items, the customer must contact HouseSmoke within 48 hours with photographic evidence. Failure to do so will result in the products being considered approved.
8.2 Defects that were not visible during proper inspection as per the previous paragraph must be reported immediately to our customer service via email at contact@housesmoke.ch upon discovery, otherwise the ordered products will also be considered accepted concerning these defects.
8.3 The defective product must be returned with a copy of the invoice and a detailed description of the defect. The return address will be communicated to the buyer via email upon receipt of the written complaint. Transportation costs incurred are at the customer’s expense.
8.4 We provide warranty by remedying defects, which can be done, at our discretion, either through subsequent performance, namely defect elimination (repair), or delivery of a defect-free item (replacement delivery). Replaced products become the property of the seller.
8.5 If subsequent performance fails, the customer has the right to terminate the contract. This does not apply in case of minor defects. Any right of the customer to a price reduction is excluded. This limitation of liability also extends to all claims that compete with warranty rights, whether contractual claims (Art. 97 ff. CO), tort claims (Art. 41 ff. CO), contesting the contract for error (Art. 23 ff. CO), etc.
8.6 The warranty does not cover normal wear and tear or the consequences of improper handling or damage, nor does it cover product manipulation by the buyer or third parties, or defects due to external circumstances. In particular, worn, soiled, or damaged items are excluded from the warranty.
8.7 The customer receives no other warranties in the legal sense from www.housesmoke.ch except for specific products and according to an individual agreement. Manufacturer warranties are not affected by this provision. The customer’s warranty right expires if repairs are carried out by unauthorized service centers. The warranty certificate and/or proof of purchase (invoice) must be carefully retained. In the absence of the latter, any warranty rights are void.
8.8 The seller assumes no responsibility for third-party descriptions, especially those of customers within customer reviews published in the online store or on our social media sites.
9. Personal Data
The information collected by HouseSmoke during any user order is necessary for the management of the order by HouseSmoke and its business partners. In accordance with the Federal Data Protection Act (LPD), the user has the right to access, rectify, oppose, and delete the data concerning them. To exercise this right, the user can contact HouseSmoke at the following address: contact@housesmoke.ch.
10. Applicable Law and Disputes
These GTCS are subject to Swiss law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing that, the dispute will be brought before the competent courts.
